3. Acceptable Use Policy

You further agree not to engage in any of the following prohibited activities:

Attempting to gain unauthorized access to any portion of the services or any other systems or networks connected to the services.
Using any automated means, including robots, spiders, or scrapers, to access the services for any purpose without our express written permission.

Any violation of this Acceptable Use Policy may result in immediate termination of your access to the services, as well as potential legal action.

4. Prohibited Activities

In addition to the Acceptable Use Policy, you are expressly prohibited from engaging in the following activities:

Any violation of these prohibited activities may result in immediate suspension or termination of your account and may subject you to civil or criminal liability.

5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, are the exclusive property of Shellsorting or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use of the services or its contents will terminate the permission or license granted by Shellsorting. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

Our services may allow users to submit, post, or otherwise transmit content, including but not limited to comments, feedback, and suggestions ("User-Generated Content"). By submitting User-Generated Content, you grant Shellsorting a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that the use of such content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights. Shellsorting is not responsible for any User-Generated Content and does not endorse any opinions expressed in such content.

We reserve the right to monitor, review, and remove any User-Generated Content at our sole discretion, without notice, for any reason, including but not limited to violations of these Terms or applicable laws.

7. Payment Terms

Access to certain features of our services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated in these Terms or required by law.

Payment will be processed through a third-party payment processor. You agree to provide accurate and complete payment information and authorize Shellsorting to charge your payment method for the fees incurred. You are responsible for maintaining the confidentiality of your payment information and for all transactions made under your account.

We reserve the right to change our pricing at any time. Any changes will be effective upon posting on our website. Your continued use of the services after any price change constitutes your acceptance of the new pricing.

8. Service Modifications

Shellsorting reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Shellsorting will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. In the event of a material change to the services, you may be required to accept new terms or conditions to continue using the services. Your continued use of the services after any such changes constitutes your acceptance of the new terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Shellsorting, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content.

In no event shall Shellsorting’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, Shellsorting’s liability is limited to the fullest extent permitted by law.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Shellsorting may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms or if we believe you are engaging in any conduct that violates applicable law or is harmful to other users or {{COMPANY_NAME}.

Upon termination of your account, your right to use the services will immediately cease, and you must cease all use of the services. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of these Terms does not affect any rights or obligations that have accrued prior to the date of termination.
